1. Acceptance of Terms
By accessing or using KTMenu ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, registered users, and restaurant owners who access or use the Service in any way.
Your acceptance of these Terms by clicking to agree, creating an account, or otherwise using the Service constitutes a valid electronic agreement under the Electronic Transactions Act, 2063 (2006) of Nepal, which recognises electronic records and electronic signatures as legally binding.
2. Description of Service
KTMenu is an online restaurant discovery platform covering the Kathmandu Valley, Nepal. The Service allows the public to browse restaurant listings, menus, opening hours, and directions. It also allows restaurant owners to create and manage their listings.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
3. User Accounts
Some features of the Service (including creating and managing restaurant listings) require a registered account. You agree to:
- Provide accurate, current, and complete information at registration.
- Maintain the security of your password and accept responsibility for all activity that occurs under your account.
- Notify us immediately at [email protected] if you suspect unauthorised access to your account.
- Not share your account credentials with any other person.
We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently.
4. Restaurant Owner Accounts
Restaurant owners who register to manage a listing on KTMenu additionally agree to:
- Accuracy: ensure that all information submitted (menus, prices, hours, contact details, photos) is accurate and kept up to date. KTMenu bears no liability for inaccuracies in owner-submitted content.
- Authority: confirm that you have the authority to submit the listing on behalf of the restaurant.
- Ownership of uploaded content: confirm that you own or have the necessary rights to any photos, menu content, logos, or other materials you upload, and that uploading them does not infringe any third-party rights.
- Compliance: ensure your listing complies with all applicable Nepal laws and regulations, including the Food Act, 2023 (1966) and Food Regulations, 2027 (1970), the Consumer Protection Act, 2075 (2018), and any local business licensing requirements imposed by the Kathmandu Metropolitan City or other relevant municipal authority.
5. Content Licence
By uploading or submitting any content (photos, menus, descriptions, logos, or other materials) to KTMenu, you grant KTMenu a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Service.
You retain ownership of your content. You can remove your listing and associated content at any time, at which point the licence above will terminate, subject to any cached or archived copies retained for legal or audit purposes.
KTMenu does not claim ownership of any restaurant content. We may remove content that violates these terms without prior notice.
6. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Submit false, misleading, or fraudulent restaurant listings or content.
- Scrape, crawl, or systematically extract data from the Service without our express written permission.
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
- Attempt to gain unauthorised access to any part of the Service or any other user's account.
- Use the Service to send unsolicited communications (spam) to restaurants or other users.
- Impersonate any person, business, or entity.
7. Accuracy of Listings: Disclaimer
KTMenu aggregates and displays information provided by restaurant owners. While we review listings before publication, we do not independently verify the accuracy of menus, prices, hours, or other listing details. Information may become outdated between updates.
KTMenu makes no warranty that any listing information is accurate, complete, or current. You should confirm details (such as opening hours and prices) directly with the restaurant before visiting. KTMenu is not responsible for any loss or inconvenience resulting from reliance on listing information.
8. Intellectual Property
The KTMenu name, logo, site design, and all content produced by KTMenu (excluding restaurant-owner-submitted content) are the intellectual property of KTMenu and are protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, KTMenu and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Service.
11. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of Nepal, including the Electronic Transactions Act, 2063 (2006), the Contract Act, 2056 (2000), and the Consumer Protection Act, 2075 (2018). Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
12. Changes to These Terms
We reserve the right to update these Terms of Use at any time. We will notify registered users of material changes by email or via a notice on the site at least 14 days before the changes take effect. Continued use of the Service after that period constitutes acceptance of the revised terms.
